CAR RENTAL AGREEMENT TERMS AND CONDITIONS

By entering into this Agreement, the “Lessee” agrees to comply with the following terms and conditions:

1. Rental Payment and Security Deposit

The Lessee agrees to rent the vehicle and pay the rental fee and security deposit on the date this Agreement is signed. In the event of any damage arising from the Lessee’s breach of this Rental Agreement, the Lessor shall be entitled to deduct the amount of such damage from the security deposit. If the security deposit is insufficient to cover the total damages, the Lessor shall have the right to claim any remaining balance from the Lessee.

2. Late Payment

In the event that the Lessee fails to pay the rental fee on time, the Lessee agrees to pay interest at the maximum rate permitted by applicable law on the outstanding amount, together with any applicable charges imposed by the Lessor, from the date of default until the rental fee has been paid in full.

3. Fuel, Parking, Tolls, and Traffic Fines

The Lessee shall be responsible for all fuel costs, parking fees, road tolls, expressway fees, and any fines or penalties imposed by law as a result of the Lessee’s violation of traffic laws or regulations.

4. Insurance Coverage and Excess

The Lessor has arranged comprehensive Type 1 motor insurance coverage for the rented vehicle. The Lessee shall be responsible for the applicable insurance excess in the amount specified in this Rental Agreement in cases where the Lessee is at fault or where no third party is involved.

5. Compliance with Insurance Conditions

The Lessee shall comply with all terms, conditions, and requirements stipulated by the insurance company. If the Lessee violates any insurance conditions or causes damage that falls outside the scope of insurance coverage, the Lessee shall be fully responsible for all resulting damages and expenses.

6. Care and Safekeeping of the Vehicle

The Lessee shall take proper care of the rented vehicle, maintain it in good condition, and keep it in a safe and secure location.

7. Permitted Use and Prohibited Activities

The Lessee agrees to use and maintain the rented vehicle with the care and diligence of a reasonable person and shall not use the rented vehicle for any of the following purposes:

  • Participating in or conducting races, competitions, speed tests, or other forms of vehicle testing.
  • Subleasing or renting the vehicle to any other person.
  • Using the vehicle for any purpose that violates applicable laws or regulations.
  • Modifying, altering, adding to, removing, or relocating any equipment, parts, or components of the vehicle without the Lessor’s prior written consent.
  • Taking or driving the rented vehicle outside the country.

8. Breach of Agreement and Termination

If the Lessee fails to comply with this Agreement or breaches any one or more of its terms and conditions, the Lessor shall have the right to terminate this Rental Agreement and immediately repossess the rented vehicle, subject to applicable law. Such termination and repossession shall not limit or prejudice the Lessor’s right to claim damages or any other amounts arising from the Lessee’s breach of this Agreement.

NOTES AND ADDITIONAL CHARGES

1. Late Vehicle Return

Additional charges for returning the vehicle after the agreed return time shall apply as follows:

  • 1–3 hours late: An additional charge of 20% of the hourly rental rate.
  • More than 3–6 hours late: An additional charge equivalent to half a day’s rental rate.
  • More than 6 hours late: An additional charge equivalent to one full day’s rental rate.

2. Fuel Level Upon Return

The vehicle must be returned with the same fuel level as recorded at the time of vehicle collection. If the fuel level is lower than the original level, the Company reserves the right to charge a refueling fee of THB 50 per liter.

3. Accident Damage Excess

In the event of an accident where the Lessee is at fault or no third party is involved, the Lessee shall be responsible for an insurance excess of THB 2,000.

No excess shall be charged if the Lessee is determined to be not at fault.

4. Early Cancellation

If the Lessee cancels the rental before the agreed rental period ends, the Company reserves the right to charge a cancellation fee of THB 500 (excluding applicable taxes). Any rental fees already paid by the Lessee shall be non-refundable in all circumstances.

5. Rental Extension

If the Lessee wishes to extend the rental period or renew the Rental Agreement, the Lessee must notify the Company at least 2 business days in advance.

Rental extensions are subject to the Company’s confirmation and availability.

6. Traffic Fines

The Company reserves the right to charge the Lessee for all types of traffic fines and penalties retrospectively if such fines or penalties are subsequently imposed or collected by government authorities in relation to traffic violations committed during the Lessee’s rental period.

7. No Pets, Smoking, or Strong Odors

The Lessee is prohibited from bringing pets into the rented vehicle, smoking inside the vehicle, or bringing any items or food with strong or unpleasant odors into the rented vehicle.
